Terms & Conditions for Tic Tac Refresh Your Vibe 2.0

BY PARTICIPATING IN THE TIC TAC REFRESH YOUR VIBE 2.0 CONTEST, THE PARTICPANT ACCEPTS THE TERMS AND CONDITIONS AS MENTIONED BELOW:

  1. The Tic Tac Refresh Your Vibe Contest 2.0
    1. Tic Tac Refresh Your Vibe Contest 2.0 (“Offer” / “Promotion” / “Promo” / “Contest”) is organized by Ferrero India Pvt. Ltd. (“Organizers” / “Company” / “Ferrero”) in association with McCann & 4MM (“Agency”).
    2. The Contest is available for participation in India except the state of Tamil Nadu and Pondicherry.
    3. Participation in this Contest is voluntary. You agree that, if you chose to participate in this Contest, you will be bound by these T&Cs and you acknowledge that you satisfy all Contest eligibility requirements as provided herein below.

  2. Contest Period & Timing
    1. Contest will be open for participation only during the “Contest period” / “Promo period”/ “Offer period” i.e., from 11th July 2025 00:01 hours to 26th July 2025 24:00 hours (both days included).
    2. Any entries coming outside the Contest period will be summarily rejected by the Company without providing any reason.
    3. The Company reserves the right to change the Contest Period or Timing, in case of any contingency, at its sole and absolute discretion, without any consent, connivance, notice or intimation to anyone.

  3. Eligibility Criteria
    1. You need to be a natural person.
    2. You should be an individual legal resident and citizen of the Republic of India.
    3. You should be of age 18 years or above at the time of entry into the Contest.
    4. You should be holding a valid PAN card or Aadhar Card.
    5. The employees of Ferrero, its associate / group companies and their children and other family members, or the employees of the Agency and their children and other family members are not eligible to participate in the Contest.
    6. The music video uploaded by individual must feature at least one of the Tic Tac product.
    7. Usage of any other product/ brand except Tic Tac in the participation video is prohibited & the same will not be considered as an entry for the Contest.

    All who fulfils the above-mentioned eligibility criteria to participate in the Contest shall individually be considered and referred to as “Participant” and collectively “Participants” for the purpose of these T&Cs.

  4. How to participate
    1. Participants must scan the QR code available on the promotional mediums or visit www.refreshyourvibe.tictac.com & follow the steps to participate.
    2. The QR code will be available on Tic Tac’s Instagram page, i.e., TicTacIndia and on all other promotional mediums such as in-store posters, contest promotion videos on Instagram & YouTube, billboards, influencer profiles on social media & in select colleges (“promotional mediums”).
    3. Upon successfully scanning the QR code, the user will be directed to the Contest website wherein they will have the opportunity to upload their music video entry.
    4. Participants must record a video of themselves by creating their own version of the track made by Yashraj Mukhate using the Tic Tac pack and other props to make the video fun & engaging and then upload on www.refreshyourvibe.tictac.com.
    5. The track made by Yashraj Mukhate will be available to watch on www.refreshyourvibe.tictac.com/ social media and Youtube channels of the Organizer.
    6. The music video format must not exceed 30 MB and should be in MP4, WebM, HEVC format only.
    7. The Participants while uploading their entry on their Instagram handle should ensure that their account is switched to “Public” mode from “Private” mode. Any entry uploaded through an account which does not adhere to this regulation will not be considered for the Contest.
    8. Music videos uploaded by the Participants should not contain any offensive, inappropriate, or copyrighted material. Ferrero reserves the right to reject any such videos summarily.

  5. Prizes
    1. Participants stand a chance to win any of the following during the Contest period upon successful submission of their entries:
    2. Daily Prizes such as BookMyShow vouchers worth Rs.5000/- (“Daily Prize”).
    3. Weekly Prizes such as Tic Tac Branded Speakers, (“Weekly Prize”).
    4. One winner will get a chance to feature in a Tic Tac music video featuring Yashraj Mukhate (‘Mega winner’), (“Grand Prize”).
    5. The rights for announcing the winner/winners for Daily, Weekly & Grand Prize/Prizes solely belongs to Ferrero India Pvt. Ltd.
    6. Winner for the Grand Prize will be announced on 30th July, 2025, or any other date as communicated by the Organizer through its social media platforms.
    7. Winners will be announced through official Tic Tac India Instagram account & the Tic tac India website.
    8. Winner/Winners will be selected upon careful evaluation of the successful entries depending on various criteria including overall creativity, music, lyrics, props used, tonality, dance movements (if any) & usage of Tic Tac product.
    9. Entries coming outside the Contest period defined above will not be considered and will be summarily rejected.
    10. The winner(s), the number of winners, the quantity, size, type, value and category of the prizes shall be determined by the Company and the Company reserves the right to vary the same to resolve the practical difficulties, if any.
    11. Prizes are non-transferable and will not be substituted by cash or any other benefit. Unclaimed / un-availed prizes will be forfeited.
    12. The winner(s) shall bear and pay all applicable, taxes (such as Gift Tax or any other applicable state or central taxes), duties, etc. on or with respect to the prizes.
    13. The Organizer shall provide the prize on an “as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and the Organizer and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product / service and / or the prize, for any damage or loss in transit or for any kind of consequential damages / loss, in any manner whatsoever. If any Participant has any grievance with respect to the prize, he / she may directly contact the respective manufacturer / service provider.
    14. The image of the prizes depicted on all communication platforms regarding this Contest, advertisements, promotional material, etc. are for illustrative purposes only and the actual prize / look of the prize may vary from the depiction made.

  6. Mega Winners
    1. By accepting the Grand Prize, the Mega winner agrees to comply with all travel, accommodation, and participation requirements as outlined below.
    2. The Mega winner will have to travel to Mumbai for one-day shoot for recording the music video with Yashraj Mukhate. The Company reserves the right to change the shoot location without any prior intimation to the Mega winner.
    3. The Company may provide for the Mega winner's travel (to and fro) to the shoot location via economy class flight or train (Chair Car), if the Mega winner resides outside Mumbai.
    4. The Company may provide one-day hotel accommodation to the Mega winner on the shoot day in a 3 or 4-star rated hotel, if the Mega Winner resides outside Mumbai. The duration of the hotel stay will align with the shoot schedule and will be communicated to the Mega winner in advance.
    5. The Company reserves the exclusive right to determine the mode of travel (flight or train) and the category of hotel accommodation (3-star or 4-star) for the Mega winner. The Mega winner is required to adhere strictly to the travel and accommodation arrangements specified by the Company. The Company's decisions regarding these arrangements are final and binding.
    6. It is expected that the Mega winner will adhere to the schedule which includes travel, stay & shoot for Tic Tac Video with Yashraj Mukhate.
    7. Any failure to adhere to the travel schedule or misconduct may result in disqualification from the Contest and forfeiture of the prize.
    8. The Mega winner must conduct themselves professionally and respectfully during all the Contest-related activities.
    9. The Company is not responsible for any personal injuries, losses, or damages incurred during travel, accommodation, or participation in the shoot.
    10. The Company is not liable for any delays or cancellations due to unforeseen circumstances beyond its control, including but not limited to natural disasters, pandemics, or government restrictions.

  7. Publicity
    1. The Participant/s, winners, family member(s) of the winner undertake and irrevocably and unconditionally permit the Organizer and / or its execution agency to use the personal details of the Participants for covering the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc. The Participants shall not raise any objection, protest or demur to such coverage or content in this regard.
    2. The Participant/s, winners, family member(s) of the winner shall, at the request of the Organizers and / its execution agency, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to using their name, image, video, etc. in promotional material.

  8. Intellectual Property
    1. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with Organizer at all times. The Organizer or any person or entity permitted by Organizer in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and / or payment to the Participant.
    2. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Organizer upon submission and become the property of Organizer exclusively. Organizer may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Organizer.

  9. Other terms and conditions
    1. The decision of Ferrero or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to Ferrero's approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
    2. The Organizer shall not entertain any grievances or queries regarding the Contest on or after 28th July 2025. Complaints and queries by Winners who have not received their prize shall not be entertained more than 60 days after they receive an SMS, Call or Direct Message (DM) on their Instagram Account from the Organizer or their appointed agency. Participants can raise their query at india@ferrero.com
    3. The Participant shall not use the Contest to post any defamatory, obscene, offensive response or response which may hurt the personal, religious, social, political or other sentiments or feelings of anyone in any manner whatsoever. The participant shall be solely responsible and liable for such response. The Company shall have the right to exclude such responses from the Promo.
    4. The participant shall not use the Contest to harm the reputation of the Company or its associate companies or any of its products including Tic Tac.
    5. The Contest is available for participation on first come basis and will be open for such participation by such no. of participants as the Organizers may select at its sole and absolute discretion.
    6. All decisions of the Organizers in any matter relating to the Contest shall be final and binding on the participants.
    7. Organizers reserve the sole right to change / edit the Contest details at any time at its discretion and /or alter these terms and conditions without any consent, connivance, notice or intimation to anyone to resolve the difficulties, if any, during implementation of the Contest.
    8. Organizers do not guarantee continuous or uninterrupted conduct of the Contest and is not liable in case of any interruption or discontinuation of the Contest.
    9. The Participants agree to have their name, personal details including photo published or uploaded on social or other media, to be used by the Organizers without any consideration, compensation and limitation.
    10. The Participants agree that the Organizers may store and use the personal information of the Participant shared for the purposes of or in connection with the Contest for the purpose of conducting the Promo as well promoting and marketing its products.
    11. Organizers reserve the right to modify or pull out the Promo without prior consent, connivance, intimation or notification.
    12. Organizers reserve the right to disqualify the Participant for infringement of these terms and conditions, before or after participation / gratification.
    13. Promotion is in no way sponsored, endorsed or administered, by Facebook or any other social media.
    14. By participating in theContest, each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest, the Participant warrants that all information provided by Participant regarding Participant’s name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
    15. By participating you hereby release and hold harmless Organizers and its employees and directors from any and all liability associated with the participation.
    16. Notwithstanding anything contained herein or in any other document or correspondence the responsibility and liability of the Organizer shall be limited to payment for the prize(s) as aforesaid.
    17. The Organizer reserves the right to exclude any person from the Contest on the ground of misconduct / criminal record / infringement of these terms and conditions.
    18. The Organizer reserves the right to terminate, modify or extend the Contest if circumstances so require.
    19. The Organizer and or its execution agencies shall not be liable for any loss or damage due to Act of God, government / statutory action and other force majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses.
    20. The Organizer and the execution agency appointed by it shall not be responsible or liable for any technical or other problems caused by any reason(s) beyond their control or due to force majeure events like strike,lock out, natural calamities, terrorist activities, etc.
    21. The Participants irrevocably agree that Organizer and / or the execution agency appointed by it are authorized to contact the Participant(s) in connection with the Offer even if the Participant(s) is / are registered under National Do Not Call (NDNC) or DND (Do Not Disturb) or any other facility.
    22. The Promo is subject to all applicable central, state and local laws, rules and regulations. These Terms and Conditions and the participation in the Promo shall be governed by Indian law and the court at Pune, India shall have exclusive jurisdiction in any matter in this regard.
    23. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.
